1) Introduction and Acceptance of Terms
These Terms & Conditions, Client Agreement and Informed Consent apply to services, sessions, readings, consultations, courses, memberships, webinars, digital products, downloads, recordings, community spaces, and related offerings provided by Shamarie Flavel, Shamarie’s Body & Mind Therapies, Shamarie.com.au, Evolve Courses, and associated Kajabi checkout pages or service platforms.
Some services may be described on shamarie.com.au and purchased, booked, delivered, or accessed through Evolve Courses, Kajabi, Stripe, PayPal, direct invoice, bank transfer, or another booking, payment, or access platform. These Terms apply regardless of where the service is described, booked, purchased, delivered, or accessed.
By booking, purchasing, enrolling, subscribing, accessing, or participating in any service, session, reading, course, membership, webinar, digital product, recording, download, or community space, you agree to these Terms.
If you do not agree with these Terms, please do not book, purchase, enrol, access, or participate in the service.
2) About Shamarie and Nature of Services
Shamarie Flavel is a complementary healthcare and wellbeing practitioner with qualifications and training in areas including naturopathy, herbal medicine, homeopathy, energy-based practice, intuitive assessment, and related wellbeing frameworks.
Shamarie’s work is integrative. Depending on the service booked, a session or offering may draw on naturopathic training, herbal or natural medicine knowledge, Biosenetics, Energy 4 Life assessment, intuitive perception, energetic interpretation, symbolic pattern recognition, client history, practical wellbeing discussion, spiritual inquiry, education, reflection, or personal development frameworks.
Some services may include natural medicine, herbal, nutritional, supplement, lifestyle, or wellbeing recommendations. Other services are primarily reflective, energetic, intuitive, symbolic, educational, spiritual, or personal-development focused. Not every session includes naturopathic, herbal, nutritional, supplement, or natural medicine recommendations.
3) Practice Philosophy and Approach
Shamarie’s work is based on the view that people have the capacity to change, heal, evolve, and develop greater self-awareness, resilience, and wellbeing.
My approach is integrative. I generally seek to understand what may be contributing to a person’s experience from a mental, emotional, energetic, spiritual, relational, lifestyle, and body-based perspective before considering physical support such as herbs, supplements, nutrients, remedies, flower essences, tissue salts, or other natural medicine options.
Where natural medicine recommendations are appropriate, they are used to support the person and their system rather than to override, force, or suppress the body. I do not generally work from a simple “symptom equals prescription” model. If you are seeking a purely symptom-based prescription without broader exploration of contributing patterns, my style of practice may not be the right fit for you.
I aim to offer support that meets the client’s current capacity, while gently inviting growth, reflection, and change where appropriate. This may include practical recommendations, energetic or intuitive insight, reflective questioning, lifestyle discussion, natural medicine support, or referral to another practitioner where needed.
My preference is to work collaboratively and respectfully with the body, the person, and the wider pattern, rather than using strong or forceful interventions where a gentler, more appropriate approach may be possible.
4) Service Categories and Scope
Shamarie offers a range of services and products. The scope of each service depends on what has been booked, purchased, or agreed.
Services may include, but are not limited to:
  • private consultations or sessions;
  • naturopathic, herbal, homeopathic, natural medicine, or wellbeing support;
  • Biosenetics sessions or Biosenetics-informed assessment;
  • Energy 4 Life assessments;
  • Soul Blueprint Readings;
  • Somatic Spiral System (SSS) readings or sessions;
  • Quantum Spiral Praxis (QSP) readings or sessions;
  • energetic, intuitive, symbolic, spiritual, or field-based interpretation;
  • meditations, recordings, or guided practices;
  • online courses, webinars, and educational programs;
  • live or recorded group sessions;
  • memberships, including Quantum Soul Upgrade or related memberships;
  • digital products, downloads, templates, handouts, and written resources;
  • community spaces, discussion areas, and group learning environments.
Each service may have its own inclusions, limitations, access period, refund terms, preparation requirements, cancellation requirements, or community expectations. Where specific terms are provided for a particular offer, those specific terms apply in addition to these general Terms.
5) Integrative Assessment, Biosenetics and Informed Intuition
Some sessions may include an integrative assessment process that draws on Shamarie’s naturopathic training, Biosenetics frameworks, Energy 4 Life assessment tools, intuitive perception, energetic observation, body/field pattern recognition, client history, and practical wellbeing discussion.
This assessment process may be described as informed intuition, because it is shaped by training, experience, symbolic frameworks, energetic perception, and the information available at the time.
You understand that integrative, energetic, intuitive, Biosenetics-informed, or field-based assessment is interpretive in nature. It is not the same as medical diagnosis, psychological diagnosis, psychiatric assessment, pathology testing, or legal, financial, veterinary, or other professional advice.
Where physical health symptoms, medical conditions, medications, pregnancy, breastfeeding, mental health concerns, safety concerns, or other practitioner care are relevant, you are responsible for disclosing that information accurately and seeking appropriate advice from suitably qualified professionals.
6) Natural Medicine, Herbal, Nutritional or Supplement Recommendations
Some services may include naturopathic, herbal, nutritional, supplement, remedy, flower essence, tissue salt, lifestyle, or other natural medicine recommendations.
Where such recommendations are provided, they are offered within Shamarie’s training, experience, and scope of practice as a complementary healthcare and wellbeing practitioner.
You understand and agree that:
  • natural medicine recommendations are not a substitute for medical diagnosis, emergency care, psychiatric care, or treatment from a registered medical practitioner where such care is required;
  • herbs, supplements, nutrients, remedies, and natural medicine products may have contraindications, cautions, or interactions;
  • you are responsible for informing Shamarie of relevant medical conditions, medications, allergies, adverse reactions, pregnancy, breastfeeding, surgeries, tests, diagnoses, mental health concerns, or treatment from another practitioner;
  • you should consult your doctor, pharmacist, specialist, psychologist, psychiatrist, or other appropriate professional where needed;
  • you should not delay urgent or necessary medical care because of any information, recommendation, reading, meditation, course, or service provided by Shamarie.
If you experience a medical emergency, mental health crisis, risk of self-harm, risk of harm from another person, or any urgent safety concern, contact emergency services or an appropriate crisis support service immediately.
7) Energetic, Spiritual, Intuitive, Symbolic and Field-Based Services
Some services may include spiritual, energetic, intuitive, symbolic, metaphysical, somatic, or field-based interpretation.
These services are offered for education, reflection, personal insight, spiritual development, self-awareness, energetic support, and general wellbeing. They are interpretive in nature and may not be scientifically measurable, independently verifiable, or capable of being proven in the same way as conventional medical or scientific information.
You understand and agree that these services are not absolute truth, fixed prediction, diagnosis, or certainty. They are offered as reflective, symbolic, energetic, intuitive, or spiritual information for your consideration.
You are encouraged to use your own discernment and to integrate any insights in a grounded and responsible way.
8) Limitations of SSS, QSP and Soul Blueprint Readings
Somatic Spiral System (SSS), Quantum Spiral Praxis (QSP), Soul Blueprint Readings and related field-based, symbolic, or intuitive readings are interpretive services. They may draw on structured codes, symbolic frameworks, energetic perception, intuitive observation, and the practitioner’s interpretation at the time of the reading.
These readings are not absolute truth, fixed prediction, diagnosis, or professional advice.
These readings are limited by the codes and frameworks available within the system. Shamarie can only interpret what has a relevant code, category, question, or clear pathway within the method being used. Some questions may not be answerable if there is no relevant code, category, field indicator, or clear interpretive pathway available within the system.
The information provided is based on what Shamarie perceives, accesses, interprets, or considers relevant at the time of the reading. A reading does not claim to reveal every factor, every truth, every cause, or every possible outcome connected with a situation.
You remain responsible for your own discernment, choices, actions, professional decisions, health decisions, relationship decisions, business decisions, spiritual practice, and how you apply any information or insight received.
You should not rely on any SSS, QSP, Soul Blueprint, energetic, intuitive, symbolic, or field-based reading as a substitute for medical, psychological, psychiatric, legal, financial, business, veterinary, crisis, or other professional advice.
9) Courses, Webinars, Memberships and Group Education
Courses, webinars, memberships, group programs, live sessions, recorded sessions, downloadable resources, meditations, and educational content are provided for education, reflection, personal development, spiritual development, energetic awareness, professional interest, and general wellbeing support.
Unless expressly stated otherwise, participation in a course, webinar, membership, group program, live session, recorded session, or digital resource does not create an individual therapeutic, naturopathic, medical, psychological, or practitioner-client relationship.
Group settings are not suitable for individual diagnosis, crisis care, personalised medical advice, personalised mental health advice, or private therapeutic treatment.
You are responsible for deciding whether participation is suitable for you and for seeking appropriate individual support where needed.
Specific membership terms, community guidelines, access terms, payment terms, or behavioural expectations may apply to particular memberships or group programs. Those specific terms apply in addition to these general Terms.
10) CPE / CPD / Professional Education Disclaimer
Some webinars, classes, workshops, or educational materials may be suitable for professional learning, continuing education, self-directed learning, or CPE/CPD record keeping.
Unless expressly stated in writing, a webinar, class, workshop, recording, or resource is not formally accredited, endorsed, or approved by any professional association, registration body, or education authority.
If you are attending for CPE, CPD, professional development, insurance, registration, or association requirements, you are responsible for checking whether the activity is suitable for your own record keeping, profession, association, or governing body.
Certificates of attendance, where provided, confirm attendance or participation only. They do not guarantee that the activity will be accepted by your professional association, insurer, registration body, or regulatory authority.
11) Personal Responsibility and Informed Consent
Your participation in any service, session, course, reading, membership, webinar, meditation, digital product, or community space is voluntary.
You understand and agree that you remain responsible for your choices, actions, health decisions, relationships, business decisions, spiritual practice, emotional wellbeing, professional decisions, and the way you apply any information or insight received.
Shamarie may offer reflections, interpretations, suggestions, practices, questions, recommendations, energetic perspectives, natural medicine support, or educational content, but you are responsible for deciding what is appropriate for you.
You are responsible for providing accurate and relevant information where required. This may include your name, date of birth, place of birth, contact details, health history, medications, allergies, pregnancy or breastfeeding status, mental health concerns, other practitioner care, or any other information relevant to the service.
You agree to seek appropriate medical, psychological, psychiatric, legal, financial, veterinary, crisis, or other professional support where needed.
12) No Guaranteed Results
While many people find this work meaningful, supportive, clarifying, or transformative, no specific result, outcome, healing, change, income, relationship shift, health improvement, spiritual experience, professional result, or life outcome is guaranteed.
Results and experiences vary from person to person.
Testimonials, examples, stories, case reflections, or shared experiences are not guarantees that you will have the same or similar results.
13) Bookings
Appointments may be booked online, through Kajabi, by direct arrangement, or through another booking or payment process.
We reserve the right to refuse, reschedule, pause, or end a session or service if it is not appropriate or safe to proceed. This may include, but is not limited to, abusive behaviour, intoxication, safety concerns, inappropriate conduct, a service being outside scope, or circumstances where another form of support is more appropriate.
14) Fees and Payment
Prices are listed at the point of purchase, booking, invoice, or checkout.
By completing checkout, booking, or payment, you agree to pay the stated price for the product, course, membership, session, reading, webinar, or service selected.
Payment may be required at the time of booking, at checkout, before preparation begins, by invoice, or by another agreed method.
Accepted payment methods may include Kajabi, Stripe, PayPal, EFT, direct debit, cash, direct invoice, or another payment processor or method.
You are responsible for ensuring your payment details are accurate and that you have authority to use the payment method provided.
15) Preparation-Based Services
Some services involve preparation before the session or delivery of the reading. These may include, but are not limited to:
  • Soul Blueprint Readings;
  • Somatic Spiral System (SSS) readings or sessions;
  • Quantum Spiral Praxis (QSP) readings or sessions;
  • written readings or reports;
  • personalised field-based or symbolic assessments;
  • other services where preparation is stated at the time of booking.
You agree to book preparation-based services with sufficient notice to allow preparation time. Unless otherwise stated, at least 48 hours’ notice is required.
You agree to provide required information promptly so preparation can be completed. This may include:
  • full name at birth;
  • current name, if changed;
  • date of birth;
  • place or location of birth;
  • questions or focus areas;
  • other information requested for the specific service.
Full payment may be required before preparation begins.
If you cancel before preparation has started, we may offer a refund or reschedule in accordance with the applicable cancellation and refund terms.
If you cancel after preparation has started, you understand that some or all of the fee may be retained to cover time already completed.
16) Cancellations, Rescheduling and No-Shows
We value your time and ours. Sessions are booked specifically for you.
Unless otherwise stated for a particular service:
  • 48 hours or more notice: You may cancel or reschedule without a late-notice fee. If you have prepaid, you may choose to reschedule to a new date/time or receive a refund of the amount paid, subject to any preparation-based work already completed.
  • Less than 48 hours’ notice: A late cancellation or rescheduling fee may apply up to 100% of the session fee. If you prepaid, the prepaid amount may be retained as the late cancellation fee unless we agree there are genuine exceptional circumstances.
  • No-show: If you do not attend your appointment, a fee may apply up to 100% of the session fee, including retaining any prepaid amount.
If you arrive late, your session may be shortened to avoid impacting the next client, and the full fee may still apply.
We will act reasonably where genuine unexpected events occur.
17) Subscriptions, Memberships and Recurring Payments
Some products, memberships, or programs may involve recurring payments.
If you purchase a subscription or membership, you authorise recurring payments according to the payment terms shown at checkout.
You are responsible for cancelling your subscription before the next billing date if you do not wish to continue.
Unless otherwise stated, cancelling a subscription stops future payments but does not automatically refund payments already processed.
Access to membership content, live sessions, recordings, community spaces, bonuses, or resources may end when your subscription is cancelled or expires.
Specific membership terms may apply in addition to these general Terms.
18) Payment Plans
If a payment plan is offered and selected, you agree to complete all scheduled payments.
A payment plan is not a subscription that can be cancelled simply because you change your mind, unless the specific offer terms state otherwise.
If a payment fails, access to the course, product, membership, or service may be suspended until payment is resolved.
You remain responsible for completing the agreed payment plan unless a refund or cancellation is required by law or agreed in writing.
19) Refund Policy
Refund terms may vary by product, course, membership, webinar, session, digital product, or service. Specific refund terms shown on the checkout page, sales page, booking page, invoice, or offer page for a particular service will apply to that offer.
Unless otherwise stated:
  • digital products, downloadable resources, recordings, meditations, templates, handouts, and instant-access content are generally non-refundable once access has been provided;
  • membership payments are generally non-refundable once the billing period has begun;
  • missed live sessions are not generally refundable where recordings, replays, or alternative access are provided;
  • preparation-based services may be partly or fully non-refundable once preparation has started;
  • change of mind does not automatically entitle you to a refund.
Nothing in these Terms limits your rights under Australian Consumer Law or any other applicable law.
20) Australian Consumer Law
Nothing in these Terms is intended to exclude, restrict, or modify any rights or remedies you may have under the Australian Consumer Law or any other applicable law, including consumer guarantees that cannot be excluded.
If a product or service fails to meet a consumer guarantee, you may be entitled to a remedy, which may include repair, replacement, refund, cancellation, compensation, or another remedy depending on the circumstances.
21) Chargebacks and Payment Disputes
If you have a concern about a payment, product, service, course, membership, or access issue, please contact Shamarie first so the matter can be reviewed.
Initiating a chargeback or payment dispute without first attempting to resolve the issue may result in suspension of access to products, services, courses, memberships, or community spaces while the matter is investigated.
This does not limit any rights you may have under Australian Consumer Law or through your payment provider.
22) Access to Digital Content
Access details are usually provided through Kajabi, email, or another digital platform.
You are responsible for using the correct email address at checkout and for checking your inbox, spam, promotions, or junk folders for access details.
If you cannot access your purchase, contact support at: shamarienews@gmail.com
Shamarie is not responsible for access issues caused by incorrect email addresses, user-side technology problems, internet issues, forgotten passwords, email filtering, or failure to check emails, unless required by law.
23) Technology Requirements
You are responsible for having suitable technology, internet access, software, audio, video, and device capability to access digital products, courses, live sessions, recordings, downloads, webinars, or community spaces.
No refund is automatically provided because of your inability to access content due to personal technology limitations, unless required by law.
24) Live Sessions, Online Consultations, Recordings, Replays and AI Summaries
Live sessions, online consultations, webinars, group calls, private Zoom sessions, or other online meetings may be recorded unless otherwise stated.
By attending a live session or online consultation, you understand that your name, voice, image, chat comments, or participation may appear in the recording if you choose to contribute.
Zoom consultations and online sessions may also use Zoom’s built-in AI or summary tools, where available. This may generate an automated transcript, notes, action summary, or session summary from the meeting. These AI-generated notes are used to assist with record keeping, follow-up, continuity of care, administrative clarity, or service delivery.
You understand and agree that AI-generated transcripts, summaries, or notes may not be complete or perfectly accurate. Shamarie may use professional judgement when reviewing, editing, storing, or relying on any AI-generated summary. AI summaries are not a substitute for your own understanding of the session or for written instructions provided separately.
Where a private consultation is recorded or summarised using Zoom AI or similar tools, the recording, transcript, or summary will be treated as part of your client record and handled in accordance with the Privacy Policy and confidentiality obligations, except where disclosure is authorised by you, required or authorised by law, or necessary for safety reasons.
If you do not consent to a session being recorded or summarised using Zoom AI or similar tools, please raise this before the session begins so that we can discuss whether the service can proceed without recording or whether another arrangement is more appropriate.
Recordings may be made available to course participants, members, purchasers, or relevant participants at Shamarie’s discretion where the session is a course, webinar, group session, or membership session.
You must not record, download, copy, share, distribute, reproduce, or repurpose live sessions, consultations, recordings, transcripts, AI summaries, or replays unless written permission has been provided.
25) Community Conduct
If you participate in a community group, live session, membership, course forum, chat, comment area, or group program, you agree to behave respectfully.
You agree not to:
  • harass, bully, abuse, threaten, or intimidate others;
  • share hate speech, discriminatory content, or deliberately harmful material;
  • shame, mock, or aggressively call out other participants;
  • give unsolicited medical, psychological, psychiatric, legal, financial, crisis, or other professional advice;
  • diagnose others or pressure anyone to stop prescribed care;
  • promote your own services, products, affiliate links, or offers without permission;
  • share private information about other participants;
  • copy, screenshot, download, distribute, or share other people’s comments, stories, names, or personal information outside the group;
  • manipulate, coerce, or pressure others to adopt your beliefs, practices, or worldview;
  • disrupt the learning, safety, or integrity of the space.
Shamarie reserves the right to moderate content, remove posts or comments, issue warnings, suspend access, or remove any person from a course, membership, session, or community space for behaviour that is unsafe, disruptive, disrespectful, or inconsistent with these Terms or the specific Community Guidelines.
Removal for misconduct does not automatically entitle you to a refund, unless required by law.
Specific Community Guidelines may apply to particular memberships or group programs.
26) Confidentiality in Group Spaces
Group spaces are not confidential in the same way as private professional appointments.
While participants are asked to respect privacy and confidentiality, Shamarie cannot guarantee that other participants will keep information confidential.
Please use discernment when sharing personal, sensitive, or private information in group spaces.
27) Privacy, Confidentiality and Records
Shamarie respects your privacy and handles personal information responsibly for bookings, service delivery, client care, digital access, course participation, communication, administration, and related business activities.
Personal information is handled in accordance with Shamarie’s Privacy Policy.
Depending on the service, information collected may include your name, contact details, date of birth, place of birth, health history, medications, allergies, symptoms, personal history, family or social history, practitioner care, booking details, payment records, course access information, or information you choose to share during sessions, courses, forms, emails, or community spaces.
Private client information is treated confidentially, except where disclosure is authorised by you, required or authorised by law, necessary to lessen or prevent a serious threat to life, health, or safety, or otherwise permitted under applicable privacy law.
Please refer to the full Privacy Policy here: https://www.shamarie.com.au/privacy-policy/
28) Infectious Illness Policy for In-Person Appointments
To protect clients and the clinic environment, please do not attend an in-person appointment if you are unwell or have symptoms of an acute infectious illness, including acute respiratory symptoms.
Where practicable, an in-person appointment may be converted to an online or phone consultation at the scheduled time.
If an online consultation is not practicable, the appointment may be rescheduled and handled under the applicable cancellation policy.
You understand that attending any in-person service where people share indoor space carries a risk of exposure to infectious illness, and we cannot guarantee you will not be exposed.
You agree that health information you provide, including about symptoms, recent illness, and exposure, will be truthful and accurate to the best of your knowledge.
To the maximum extent permitted by law, you agree you will not hold Shamarie’s Body & Mind Therapies liable for exposure to or infection with an infectious illness connected with attending the clinic, except where liability cannot be excluded under applicable law.
29) Email Communication and Marketing
By purchasing, booking, enrolling, or subscribing, you agree to receive transactional emails related to your purchase, access details, reminders, updates, receipts, bookings, and service delivery.

This includes sharing login details, forwarding course content, copying meditations, distributing downloads, using symbols or frameworks, recording live sessions, or republishing materials.
Free Resources, Meditations and Digital Items
From time to time, Shamarie may provide free resources, meditations, recordings, handouts, downloads, templates, videos, written materials, email resources, or other digital items.
Free resources are provided for personal education, reflection, spiritual development, energetic awareness, personal insight, and general wellbeing support only.
Unless written permission is provided, free resources are for your own personal use only. You must not copy, reproduce, distribute, sell, share, upload, teach from, modify, repurpose, or include them in paid services, client work, public teaching, commercial programs, or professional training.
Free resources, meditations, recordings, and digital items are not personalised advice and are not a substitute for medical, psychological, psychiatric, legal, financial, veterinary, emergency, or crisis care.
You are responsible for deciding whether a free resource, meditation, or digital item is suitable for you. If you feel distressed, dysregulated, unwell, unsafe, or uncomfortable while using a meditation, recording, or resource, please stop using it and seek appropriate support if needed.
Access to free resources may be changed, removed, paused, or discontinued at any time.
By downloading, accessing, or using a free resource, you agree to these Terms, the Privacy Policy, and any specific terms shown at the time of download or access.
If the free item is accessed by subscribing to an email list, you may receive educational emails, updates, offers, or related communications. You can unsubscribe from marketing emails at any time.
32) Account Access and Sharing
Your purchase, booking, membership, course access, or digital product access is for your own individual use unless otherwise stated.
You must not share your login details, account access, course materials, recordings, membership content, digital products, or downloads with another person.
Shamarie reserves the right to suspend or cancel access if account sharing is suspected.
33) Bonuses and Limited-Time Access
Some offers may include bonuses, live calls, replays, downloads, limited-time access, or additional resources.
Bonuses are provided at Shamarie’s discretion and may change, expire, or be removed.
Unless lifetime access is specifically stated, access may be limited by the terms of the offer, membership, program, or platform.
34) Changes to Products, Courses, Services or Schedules
Shamarie may update, improve, restructure, pause, replace, or retire products, courses, memberships, content, schedules, live sessions, recordings, community spaces, or services from time to time.
Where possible, reasonable notice will be provided for significant changes that affect paid access.
35) Platform Access and Third-Party Services
Some products and services are delivered through Kajabi or other third-party platforms.
Shamarie is not responsible for outages, interruptions, policy changes, technical issues, service limitations, payment processing issues, email filtering, or access issues caused by third-party platforms, though reasonable efforts will be made to assist where possible.
Your use of third-party platforms may also be subject to their own terms and privacy policies.
36) Safety and Suitability
Some content may involve emotional reflection, spiritual inquiry, meditation, energy work, personal pattern recognition, body awareness, or self-exploration.
You are responsible for deciding whether participation is suitable for you.
If you have significant trauma, mental health concerns, medical conditions, crisis-level distress, risk of self-harm, risk of harm from another person, or urgent safety concerns, please seek appropriate professional or crisis support before participating.
Shamarie reserves the right to decline, pause, discontinue, or refer out a service if it is not suitable, is outside scope, or if continuing would be unsafe or inappropriate.
37) Limitation of Liability
To the maximum extent permitted by law, Shamarie is not liable for any loss, damage, injury, claim, cost, or consequence arising from your use of, participation in, or reliance on any product, course, membership, session, reading, meditation, community space, digital resource, website content, recommendation, or service.
This does not exclude, restrict, or modify any rights or remedies that cannot be excluded under Australian Consumer Law or other applicable law.
38) Complaints, Concerns, Dispute Resolution and Respectful Communication
If you have a concern, complaint, misunderstanding, or dissatisfaction with a service, product, course, membership, communication, payment, or other matter connected with Shamarie’s Body & Mind Therapies, Shamarie Flavel, Shamarie.com.au, or Evolve Courses, you agree to raise the matter with Shamarie directly in the first instance where reasonable.
Where possible, concerns should be raised in writing by email so that the issue can be clearly understood and responded to.
We aim to approach concerns respectfully, fairly, and collaboratively. In the first instance, we will seek to clarify the issue, understand your concern, and explore whether a reasonable resolution can be reached.
If the matter cannot be resolved directly, both parties agree to consider mediation or another appropriate dispute-resolution process before commencing legal action, unless urgent legal action is necessary or a legal right prevents this step from being required.
You agree to communicate concerns, complaints, feedback, reviews, or public comments in a truthful, fair, and respectful way. You agree not to knowingly make false, misleading, malicious, abusive, or defamatory statements about Shamarie Flavel, Shamarie’s Body & Mind Therapies, Shamarie.com.au, Evolve Courses, services, products, courses, memberships, participants, or community spaces.
This clause does not prevent you from raising a genuine complaint, giving honest feedback, seeking professional advice, making a lawful report, participating in mediation, exercising consumer rights, or taking any action that cannot lawfully be restricted.
Nothing in this section limits any rights you may have under Australian Consumer Law or any other applicable law.
39) Changes to These Terms

3) Bookings
Appointments may be booked online or by arrangement. We reserve the right to refuse, reschedule, or end a session if it is not appropriate or safe to proceed (for example, abusive behaviour, intoxication, or safety concerns).
4) Fees and payment
4.1 Standard payment rule (most clients)
Payment is required at the time of booking to secure your appointment. Your booking is not confirmed until payment has been received.
4.2 Services paid in advance (mandatory)
The following services must be paid in advance:
  • Soul Blueprint
  • Somatic Spiral System (SSS)
  • Quantum Spiral Praxis (QSP)
(These services include preparation time. See Section 5.)
4.3 Long-term clients — pay after session (by approval only)
Only clients approved by us as Long-Term Clients may pay at the completion of the session. This is a privilege, not an entitlement, and may be withdrawn at our discretion (for example, after a late cancellation/no-show or overdue payment).
4.4 Payment methods
Accepted payment methods: EFT / cash / direct debit (edit as needed).
5) Preparation-based services (Soul Blueprint, SSS, QSP)
5.1 Preparation time and booking window
Soul Blueprint, SSS and QSP sessions involve preparation. You agree to book these appointments at least 48 hours in advance to allow preparation time.
5.2 Required information
You agree to provide the required details promptly so preparation can be completed. This includes:
  • Full name at birth
  • Current name (if changed)
  • Date of birth
  • Place/location of birth
5.3 Prepayment before preparation begins
Full payment is required before preparation is performed on your behalf.
5.4 Cancellations for preparation-based services
  • If you cancel before preparation has started, we may offer a refund or reschedule (see Section 6).
  • If you cancel after preparation has started, you understand that some or all of the fee may be retained to cover time already completed.
6) Cancellations, rescheduling, and no-shows
We value your time and ours. We book sessions specifically for you.
  • 48+ hours’ notice: You may cancel or reschedule without a late-notice fee. If you have prepaid, you may choose either:
    • Reschedule to a new date/time, or
    • Receive a refund of the amount paid.
      Refunds are returned via the original payment method where possible.
  • Less than 48 hours’ notice: A late cancellation/reschedule fee may apply up to 100% of the session fee. If you prepaid, you agree the prepaid amount may be retained as the late cancellation fee, unless we agree a genuine exceptional circumstance.
  • No-show: If you do not attend, a fee may apply up to 100% of the session fee (including retaining any prepaid amount).
We will act reasonably where genuine unexpected events occur.
7) Late arrival
If you arrive late, your session may be shortened to avoid impacting the next client, and the full fee still applies.
8) Infectious illness policy (including COVID-19) — in-clinic appointments
To protect clients and the clinic environment:

8.1 If you are unwell, you will be seen online

If you are unwell (including on the day) or have symptoms of an acute respiratory infection (including symptoms consistent with COVID-19), you agree your appointment will be converted to an online consultation (phone/video) at the scheduled time where practicable.

If an online consultation is not practicable, the appointment will be rescheduled and handled under the cancellation policy.

8.2 Acknowledgement of risk

You understand that attending any in-person service where people share indoor space carries a risk of exposure to infectious illness, including COVID-19, and we cannot guarantee you will not be exposed.

8.3 Client responsibility for accurate information

You agree that health information you provide (including about symptoms, recent illness, and exposure) will be truthful and accurate to the best of your knowledge.

8.4 Liability (to the extent permitted by law)

To the maximum extent permitted by law, you agree you will not hold Shamarie’s Body & Mind Therapies liable for exposure to or infection with COVID-19 (or other infectious illness) connected with attending the clinic, except where liability cannot be excluded under applicable law.

9) Consumer rights (Australian Consumer Law)
Nothing in these Terms is intended to exclude, restrict, or modify any rights or remedies you may have under the Australian Consumer Law, including consumer guarantees that cannot be excluded.
